This Terms and Conditions Agreement (the 'Agreement') is between SIA Rompolo (the 'First Party') and the user (the 'Second Party'). Each may be referred to individually as a 'Party' and collectively as the 'Parties'. This Agreement specifies the terms governing the use of SIA Rompolo's digital album services. By accessing and utilizing the services provided by the First Party, the Second Party consents to comply with this Agreement's terms.
SIA Rompolo offers a digital platform enabling the Second Party to create digital albums and upload images. The First Party provides various plans, each with distinct terms regarding storage duration and conditions.
Free plan: This plan is offered at no cost. Under the Free Plan, files will be stored for 7 days, after which they will be removed unless a paid plan is purchased.
Pay-once plan: Under this plan, files will be stored for a 6-month period.
Subscription plan provides file storage for a 1-year period.
The Second Party bears sole responsibility for any content they upload to the platform, ensuring it is lawful. By uploading content, the Second Party confirms they possess all necessary rights or permissions and accepts liability for any infringements.
The Second Party agrees to pay the fees associated with their selected plan. Specific fees for each plan are outlined at the time of purchase. There are no refunds, and content will be removed post-plan expiry unless renewed.
Storage duration and costs are plan-dependent. The First Party is not liable for changes in storage costs.
Company closure: If the company ceases operations, the First Party will attempt to notify the Second Party, but cannot guarantee the storage of files for the initially purchased period.
Increase in Underlying Storage Costs: If the price of the underlying storage service increases, the First Party reserves the right to not store the files for the entire purchased period, despite efforts to inform the Second Party.
Price stability or decrease: If the cost of underlying storage remains unchanged or decreases, files will be stored for the duration of the purchased period.
The First Party is exempt from liability for any damages, content loss, or business disruptions from service use. Specifically, the First Party shall not be held liable for any loss, alteration, or unauthorized access to the Second Party's data, including images and videos, resulting from hacking, system failures, or errors. The Second Party acknowledges that they use the service at their own risk and are responsible for maintaining appropriate backups of their content.
This Agreement is governed by the laws of the First Party's jurisdiction, with any disputes exclusively resolved in its courts.
By using SIA Rompolo's services, the Second Party acknowledges and agrees to these Terms and Conditions, including the amended clauses regarding storage adjustments based on underlying cost changes and the addition of the Free Plan.
